Man City appeal guilty verdict, claiming serious errors of law & fact
Post
๐ฐ Manchester City lodged a formal appeal on 1 October against the ruling that they breached Premier League financial rules.
๐ Key points
โ๏ธ City submitted their appeal at 7pm on 1 October.
๐ฃ๏ธ The club claim the ruling contains errors of law, principle and fact.
๐
The period in question covers nine seasons, from 2009/10 to 2017/18.
๐ฅ The appeal will be heard by a three-person appeal board, different from the original panel.
๐๏ธ The FA said the matter has significant implications for the integrity of the game and it will be monitoring it.
๐ What happened
โ๏ธ In a ruling published on 29 September, an independent commission found that City had breached Premier League financial rules between the 2009/10 and 2017/18 seasons. According to Al Jazeera and ESPN, the commission found that revenue had been inflated and costs reduced through so-called "sham" commercial deals, and upheld three of the four charges of failing to cooperate with the investigation.
๐ฃ๏ธ City lodged their appeal at 7pm on the evening of 1 October. The club said the ruling was unsafe because it contained clear and serious errors of law, principle and fact, and reiterated that they are innocent of the charges brought by the league. CEO Ferran Soriano rejected as untrue the claim that the owner's personal money had been secretly funnelled in through sponsors.
๐๏ธ The following day, the Football Association issued a brief statement. It said the commission's decision has significant implications for the integrity of the game, and that it would review it carefully and take action if necessary. However, it added that as proceedings between the league and the club are ongoing, it would make no further comment and would monitor the situation.
๐ฅ The appeal will be heard in private by a three-person appeal board, different from the original panel. Sky Sports reported that the appeal process must be completed within 12 weeks, with a decision due within 30 days of the hearing ending. Sanctions have yet to be decided.
๐ By the numbers
โข Period in question: 2009/10 to 2017/18 seasons (9 years)
โข Scale of inflated revenue and reduced costs: around ยฃ900m (ESPN, Al Jazeera)
โข Failure-to-cooperate charges: 3 of 4 upheld
โข Appeal hearing deadline: within 12 weeks (Sky Sports)
๐ญ Why it matters
The outcome of the appeal will determine the severity of any sanctions, such as fines or points deductions. Al Jazeera listed possible sanctions ranging from a reprimand, fines and suspension to points deductions and expulsion. If Sky Sports' reporting is right, a verdict on the appeal could arrive around the end of the year, or around mid-January at the latest. Until then, City will have to play their season under the shadow of the ruling.
